Even trial lawyers go to mediation

Unlike at many personal injury firms, where only a select few attorneys have trial experience, all of the attorneys at Greenberg Law P.C. are established trial attorneys with court room experience before judges and juries. While going to trial may be one way to resolve a case for money compensation, most cases are resolved by settlement negotiation.

Mediation is one form of settlement resolution, or alternative dispute resolution (ADR). Mediation is a voluntary and non-binding process whereby the parties engage with a neutral mediator to see if they can come to a resolution that satisfies all parties. Success at mediation requires experience in presenting the strength of a case, negotiating value, and knowing when to stand tough in insisting on trial. The most strategic attorneys know when to turn to mediation, as opposed to trial: if trial costs would be prohibitive in the face of a low potential for recovery; when the client elects not to participate in a trial; where necessary evidence to make a successful argument in Court is unavailable; or, where a speedier recovery is key.
