Topics in Personal Injury: NYC Injury Claim on Decline

Based on a recent report by the NYC City Comptroller, the total number and amount of claims against New York City both significantly dropped from 2018 to 2019. If you have a personal injury claim against NYC the reports can give an idea of how the city may address the claims.

  • Tort Claims: Payouts on personal injury claims only fell by about 1%, but payouts fell by about 7% from 2018-2019.
  • Medical Malpractice: in 2019, 482 claims were filed, which was an increase from the previous year. In addition, there was also an increase in the total cost of judgments and settlements.
  • Police Department Claims: There was also a drop in torts claims against NYPD in 2019. In 2019, 5,848 claims were filed which was a seven percent decrease in settlements /claims paid from the previous year
  • Department of Sanitation: Claims against the Department of sanitation in 2019 were almost $7 million less than in the previous year

The reports also cover other types of claims including employment and special education claims. Of note, sidewalk claims were one of the most filed complaints in 2019. As the report makes clear, NYC will work hard to pay as little as they can in personal injury claims.
